Welcome to Arsel AI, a service provided by Evotik Innovations FZ-LLC, based in the UAE. By accessing or using Arsel AI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using our platform.

1. Acceptance of Terms

1.1 By using Arsel AI, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.
1.2 If you do not agree with any part of these Terms, you may not use the Service.
1.3 These Terms apply to all visitors, registered users, and API clients.

2. Scope of Service

2.1 Arsel AI provides email validation and verification services through APIs, SDKs, and a web interface. Features include syntax validation, DNS and MX record lookups, disposable domain detection, catch-all detection, SMTP inbox verification, and optional machine-learning–based risk scoring.
2.2 The Service may also include integrations with CRM, SaaS, and marketing platforms, reporting dashboards, and bulk processing.
2.3 We continuously enhance and expand the Service. Features may be modified or discontinued with notice, without liability to you.

3. License and Acceptable Use

3.1 You are granted a limited, non-exclusive, revocable license to use the Service in accordance with these Terms.
3.2 You may not:

  • Modify, copy, resell, or redistribute the Service or its data, except as permitted by your subscription plan.
  • Use the Service to send unsolicited commercial messages, spam, phishing campaigns, or bulk marketing without proper opt-in.
  • Reverse engineer, decompile, or attempt to extract source code or algorithms.
  • Circumvent rate limits, usage restrictions, or subscription tiers.
  • Use the Service in any way that violates applicable law or infringes third-party rights.
    3.3 We reserve the right to suspend or terminate your license for violations.

4. User Accounts and Security

4.1 You are responsible for maintaining the confidentiality of your account credentials and API keys.
4.2 You must notify us immediately if you suspect unauthorized access.
4.3 Arsel AI is not responsible for losses resulting from compromised accounts.

5. Fair Use Policy

5.1 Free accounts are subject to fair use limits (daily and monthly request caps, rate limits, and restrictions on bulk usage). These limits are designed to ensure equitable access for all users.
5.2 Paid plans offer higher limits and priority processing.
5.3 Excessive usage beyond fair use limits may result in throttling, delayed responses, or suspension.
5.4 AI feature limits: AI features (such as template building, message writing and optimization, and spam-probability scoring) are subject to a monthly request cap: 10 requests per month for free accounts (without an active subscription) and 500 requests per month for subscribed accounts. These limits are counted per month and reset at the start of each cycle.
5.5 Once you reach the monthly AI feature limit, additional requests may be temporarily paused until your cycle renews or you upgrade your plan. We reserve the right to adjust these limits from time to time to ensure fair use and service stability.

6. Queuing and Processing Priority

6.1 All requests are processed on a first-come, first-served basis.
6.2 Free accounts and paid accounts are queued separately. Paid accounts always receive higher priority.
6.3 If system load is high, free requests may be delayed to ensure stability.

7. Payments and Subscriptions

7.1 Arsel AI offers free and paid (“Pro”) subscription tiers.
7.2 Subscription payments are handled by Stripe or other payment providers. We do not store your card details.
7.3 Pricing, renewal terms, and cancellation policies are displayed on our pricing page.
7.4 We reserve the right to adjust fees and features. Notice will be provided for changes impacting active subscribers.

8. Refunds

8.1 Refunds are processed in line with our Refund Policy.
8.2 We may decline refunds for partial usage or violations of these Terms.

9. Local Currencies and Credits

9.1 Prices are denominated in US dollars, but local currencies may be supported by our payment processors.
9.2 Exchange rates and conversion fees are applied by payment providers.
9.3 Credits or promotional balances may be granted for testing or marketing. Credits are non-refundable and expire within three months unless otherwise specified.

10. Promo Codes

10.1 Promo codes may be issued for discounts.
10.2 Codes are non-transferable, limited to one per user, and subject to expiration.
10.3 Misuse or fraudulent use of promo codes may result in suspension.

11. Taxes

11.1 Depending on your location, Arsel AI may charge VAT, GST, sales tax, or other indirect taxes.
11.2 Taxes are added to listed prices and displayed before checkout.
11.3 Users are responsible for reporting and paying any applicable income or corporate taxes.

12. Accuracy of Results

12.1 Email validation results are based on live lookups and probabilistic methods. No system can guarantee 100% accuracy.
12.2 Results should be treated as risk indicators, not definitive confirmations.

13. Intellectual Property

13.1 All content, software, code, designs, and trademarks related to Arsel AI are the property of Evotik Innovations FZ-LLC or its licensors.
13.2 Unauthorized use of branding or proprietary materials is prohibited.

14. Abuse and Restrictions

14.1 You may not use Arsel AI in illegal, abusive, or unethical ways, including but not limited to:

  • Sending or facilitating spam.
  • Harvesting or reselling personal data.
  • Circumventing usage limits.
  • Using the Service for phishing, fraud, or identity theft.
    14.2 We reserve the right to:
  • Block or throttle specific IPs or networks.
  • Suspend or terminate abusive accounts.
  • Deny access to individuals or groups misusing the Service.

15. Third-Party Links and Services

15.1 Arsel AI may contain links or integrations with third-party platforms.
15.2 We are not responsible for third-party content or security practices.

16. Disclaimers

16.1 The Service is provided “as is” and “as available.”
16.2 Arsel AI makes no warranties, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.

17. Limitation of Liability

17.1 To the maximum extent permitted by law, Arsel AI and its affiliates are not liable for indirect, incidental, special, or consequential damages.
17.2 Our liability is limited to the amount paid by you in the preceding 12 months.

18. Disputes and Cancellations

18.1 Users should attempt to resolve disputes through Customer Support before contacting payment providers.
18.2 Chargebacks filed without first contacting support may result in suspension.
18.3 We reserve the right to cancel or reverse transactions suspected of fraud.

19. Modifications to Terms

19.1 We may update these Terms periodically.
19.2 Continued use of the Service constitutes acceptance of the revised Terms.
19.3 Significant changes will be communicated via email or in-app notifications.

20. Governing Law

20.1 These Terms are governed by the laws of the United Arab Emirates.
20.2 Disputes will be subject to the exclusive jurisdiction of UAE courts.

21. Marketing Usage

21.1 By using the Service, you grant us a limited, non-exclusive license to display your company’s name and logo in our marketing materials.
